Zoning By-Law Amendment

Zoning protects areas from incompatible land uses and establishes standards for development. Zoning by-laws contain specific provisions for building, setbacks from property lines, the amount of parking required for specific uses, along with other matters. View the Comprehensive Zoning By-Law.

When is a Zoning By-Law Amendment needed? 

  • a proposed use is not permitted in the zone for a property;
  • a condition of a consent application;
  • commercial or industrial use;
  • if the standards of that zone cannot be met by a proposed development; or
  • the proposal does not meet the intent of the comprehensive zoning by-law

A zoning by-law amendment is a by-law passed by Council. Since the Zoning By-law implements the Peterborough County Official Plan, a zoning by-law amendment must conform to the Official Plan. If it does not, you might need an official plan amendment before applying for a proposed Zoning By-law amendment.

It is encouraged that applicants request a Pre-consultation- Zoning By-law Amendments and Site Plan Application must be completed and a meeting scheduled with the Township's Junior Planner prior to a Zoning By-Law Amendment Application or for a Site Plan Approval Application being submitted for processing.

Archaeological Assessments

 Please note that through recent consultation with Curve Lake First Nation (CLFN), it has been suggested that archaeological assessments may be required for development on waterfront properties. You will need to complete the attached checklist from the Province for evaluating archaeological potential to determine whether an archaeological assessment is required. This checklist needs to be submitted with any application submitted. Should you determine that an archaeological assessment is required, we would encourage follow up discussion with the Township and Curve Lake to confirm specific requirements.

Request for Pre-Consultation

Application for an Amendment to the Restricted Area (Zoning) By-Law

Your re-zoning application will be reviewed by planning staff to determine that it is complete. You will be advised within 30 days of the application having been submitted as to whether or not it is complete. If the application is not complete, we will let you know what information is missing so you can provide that material.

Once your application is complete, staff will process the application and send out a notice of a public meeting that will be provided to any property within a 120 metre radius of the property. Notices will also be circulated to the relevant agencies 20 days prior to the hearing date. The notice and information submitted with it will be available to the public upon request.

Our staff will prepare a report with a recommendation to be considered at the public hearing before Council. As the applicant, you'll have an opportunity to present any further details or information at the public meeting. The public is also invited to submit comments or speak on behalf of the application by submitting a request in writing to the Clerk or Planning staff.

After the meeting, a decision will be circulated to the owner and agent as well as the County of Peterborough.
